Short Sale: If you must sell, can not stay in the home, or do not qualify for a loan modification, contact a real estate agent. Many agents hold a designation of CDPE showing they specialize in Distressed Properties/Short Sales. Your agent’s general goal is to have your lender agree to let you sell your home for less than owed and agree to not seek deficiency. HINTS: To qualify for a short sale your lender will generally have a requirement that you have a valid hardship, i.e.: loss of income, medical bills, job relocation, some family situations, and that you are not current on payments due to the hardship. Exceptions apply. Talk to your agent, every situation is different, you will decide together if a short sale is right for you.

Foreclosure: Damaged credit, risk of deficiency judgment by your lender, risk of tax liability on the deficiency. Take the banks calls, DO NOT Ignore them. Every time they call ask if a sale date is set. That is the date you need to be out of the home. Let them know you are still in the home and caring for the home. If you still want to keep the home, let them know you are still willing to work things out with them. HINTS: Always keep the yard mowed and well maintained. If the home is neglected or looks vacant, or you ignore calls and they think you abandoned the property they will change the locks. Foreclosures take an average of 6 months to 2 years, but could go longer, no two are the same.
HOW DO I CHOOSE: It is generally felt that if your only financial issue is your home, consider a loan modification, short sale, or deed in lieu. If you have a large amount of financial issues that you can not handle i.e.: if you’re behind on credit cards and other bills, along with your mortgage, talk to a bankruptcy attorney. BUT PLEASE, DO NOT “DO NOTHING”! It is never the best option.
